Answer to ' Interpello n.8 of March 3, 2011, the Ministry of Labour has confirmed that the excess of the maximum number of part-time provided by the National Collective Bargaining Agreement requires the company and irregularities hence the failure to release DURC.
In summary, with particular regard to the construction sector, where the limit is equal to 3% of workers hired for an indefinite period, an indemnity in breach of that limit would be considered made in the absence of requirements for standing and therefore the employment relationship can not be considered part-time triggering the application of virtual contribution, the resulting failure to pay and failure to release DURC.
