The Treasury pays for self-defense and denied unjustly




With No Judgement 3 March 5120 2011, the Court of Cassation determined that the taxpayer had to appeal at the Tax Commission for an act of the administration was not accepted because the application of self-defense should be compensated for the damage in addition to legal fees and to confer with those of the office (for example, costs for the professional).
In this case, after the empty instances of self-defense presented by the taxpayer, the department acknowledged the error by proposing a measure of repayment of the amounts entered in the register.
The taxpayer has had to ask the Justice of the Peace to obtain compensation for damage resulting in use of financial administration that the Supreme Court has also upheld then the additional demands of the taxpayer.
